PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 28 April 1997, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l1, AR 635-200, by reason of entry level performance and conduct. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a characterization of service of uncharacterized.

         b. On 2 May 1997, the applicant was discharged. At the time of discharge, the applicant had completed 3 months, and 25 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of that regulation provides, in pertinent part, that a member may be separated for unsatisfactory performance or conduct, or both, while in an entry-level status. A soldier is in an entry level status, if before the date of initiation of separation, they have completed no more than 180 days of credible continuous active duty. Service for soldiers separated under this chapter is uncharacterized.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(3) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The evidence of record shows that the applicant was discharged under the provisions of Chapter 11, AR 635-200, by reason of entry level performance and conduct with service uncharacterized. The applicant’s unit commander, in the separation packet, confirmed that the applicant lost his motivation to serve due to misinformation received from his recruiter on his eligibility to enter the Physician’s Assistant (PA) Program. Through no fault of his own the applicant is now stigmatized by a narrative reason for separation that implies that his conduct and performance was less than acceptable. Notwithstanding the propriety of the applicant’s discharge, the Board determined that the discharge was and is inequitable. Accordingly, the Board voted to grant full relief in the form of an upgrade of characterization of service to fully honorable and a change to the narrative reason for separation to Secretarial Authority.
